Spilman Thomas & Battle, PLLC
Spilman Thomas & Battle is a full-service law firm with a dedicated Local Government & Public Entity Practice Group. The group’s lawyers represent Virginia and West Virginia localities, other public entities, and public officials in a wide array of legal matters—ranging from general representation as county, city, and town attorney and counsel to authorities and other political subdivisions to service as specially retained counsel in matters involving difficult personnel issues, workplace or other investigations, § 1983 and state law tort defense, contract negotiation and litigation, zoning ordinance defense, drafting ordinance and policy updates, local tax advising and defense, municipal bonds, infrastructure, economic development, and affordable housing. In these and other areas, Spilman’s attorneys provide the legal advice and solutions local governments, public officials, and other public entities need in a complex and ever-evolving legal landscape. In Virginia, Spilman currently represents eight localities as county, city, or town attorney, with a total population of more than 100,000. It also represents over a dozen public service authorities, planning district commissions, educational institutions and school divisions, economic development authorities, and redevelopment and housing authorities serving tens of thousands of citizens. Our attorneys frequently are called upon to handle complex litigation in state and federal court for local governments, public entities, and their employees. Among our most common tasks are defense of discrimination, retaliation, and whistleblower claims, defamation and liberty interest claims, excessive force and First Amendment claims, zoning and land use claims, construction disputes, and mandamus and declaratory judgment cases. We also handle environmental issues with the DEQ and local tax cases. Our transactional team assists with detailed and difficult issues of local government law, such as advice on local tax issues, updating personnel manuals, zoning and subdivision interpretations, complex real estate transactions, utility system acquisitions, and capital projects in the tens of millions of dollars from soup to nuts as outside project counsel. Among our major projects are huge water and sewer projects, broadband projects, courthouse and school design and construction projects, and economic development and affordable housing projects. Our transactional team is focused on getting things right the first time—saving local governments hundreds of thousands of dollars in litigation costs and untold political issues. Our Bond and Public Finance Practice Group works with governmental entities on municipal bond issues and syndication of tax credits. We work on the issuance of tens of millions of dollars of municipal bonds every year, including general obligation bonds, revenue bonds, financing leases, private activity, housing, and 501(c)(3) bonds, and syndication of historic tax credits and low income housing tax credits. In conjunction with our transactional work on capital projects, economic development, and housing deals, this puts Spilman in a unique position to assist local governments on the toughest issues facing them right now.
